The State of Psilocybin in Canada, 2026.

Where the law stands, how people reach psilocybin lawfully, and what Canadian research is testing: one dated, sourced report with charts you can reuse.

SECTION 1

The law in 2026.

Federal status. Psilocin and psilocybin are in Schedule III of the Controlled Drugs and Substances Act. Health Canada says the production, sale and possession of magic mushrooms are illegal unless Health Canada authorizes them. New federal Controlled Substances Regulations took effect on 1 October 2026; they list psilocin and psilocybin as restricted drugs and do not make magic mushrooms legal. Bill C-286, a private member’s bill about psilocybin, has had only first reading. Health Canada also says that, at this time, there are no approved therapeutic products containing psilocybin in Canada or elsewhere (Health Canada: Psilocybin and psilocin (magic mushrooms), page dated 2026-10-20; Controlled Drugs and Substances Act, Schedule III (Justice Laws); Controlled Substances Regulations, SOR/2025-242 (Canada Gazette, Part II, 17 December 2025)).

Provinces. Federal law applies in every province and territory. Our law tracker has separate entries for the three provinces with something provincial to report; the rest of the country follows the federal position alone.

SECTION 2

Access routes.

Clinical trials

Health Canada calls clinical trials the most appropriate and effective way to advance research with psilocybin. Each trial needs research ethics board approval (Health Canada: Psilocybin and psilocin (magic mushrooms), page dated 2026-10-20). Health Canada’s question-period note of December 2022 said it had approved 16 clinical trials involving psilocybin, 13 of them since the start of 2022 (Health Canada Question Period Note MH-2022-QP-0026 (14 December 2022), Open Government Portal).

Special Access Program

A practitioner, not a patient, can request a drug that is not approved for sale. Requests are assessed case by case and approval is not guaranteed. Practitioner access to psilocybin through the program was restored in January 2022 (Health Canada: Psilocybin and psilocin (magic mushrooms), page dated 2026-10-20). As of 4 November 2022, Health Canada had authorized psilocybin through the program for 50 patients (Health Canada Question Period Note MH-2022-QP-0026 (14 December 2022), Open Government Portal).

Section 56(1) exemptions

A discretionary power of the Minister to exempt a person from the Act for scientific, medical or public-interest purposes; Health Canada says the other routes should generally be pursued first (Health Canada: Psilocybin and psilocin (magic mushrooms), page dated 2026-10-20). The Minister refused a group of practitioners’ requests on 9 June 2022 (Health Canada Question Period Note MHA-2022-QP-0003 (14 December 2022)), and in June 2025 the Federal Court of Appeal sent that decision back. We found no official total of exemptions granted. Section 56, explained.

Special Access Program: psilocybin requests and authorizationsHealth Canada data obtained under Access to Information, reported by Garel, Plourde, Greenway and Dorval, Nature Mental Health (2025), Health Canada data obtained under Access to Information. Requests, not patients.

Across 2022 to 2024 the program processed 436 psilocybin requests and authorized 304, or 69.7%. Requests doubled between 2022 and 2024 while the share authorized fell from 82% to 59.1%.

Health Canada itself has not published newer psilocybin figures that we could find. The 2022 question-period note counts patients (50 by 4 November 2022), while the Access to Information figures count requests, so the two can’t be compared directly. An authorization is permission to supply, not evidence that treatment happened or worked.

Canadian-affiliated publications on psilocybin rose from 4 in 2020 to 55 in 2025. Worldwide, the same search found 82 papers in 2020 and 464 in 2025, so Canada’s share was about 12% in 2025.

These are counts of records, not of studies or findings: a review, a protocol and a trial report each count once, and affiliation matching misses records without full affiliation data. See methods.

Canada vs the world.

Canada sits with most countries in our tracker: psilocybin is controlled, with research and case-by-case exceptions. What sets other places apart is a defined route that Canada does not have, such as a state-licensed adult program or a prescribing rule for one condition.

Types of rule, place by placeFrom our law tracker, entries checked 4 October 2026 to 17 October 2026. A place can have more than one type.

How the data was gathered

  • Clinical studies. We queried the ClinicalTrials.gov API v2 on 26 October 2026 (14:09 UTC) for studies with “psilocybin” as an intervention and a location in Canada, and saved the answer. All 41 returned records list at least one Canadian site. Status, phase, conditions, dates, sites and sponsors are the registry’s own; we only grouped conditions into plain-language buckets and merged spellings of province names.
  • Research output. Europe PMC REST API hit counts on 26 October 2026, for MEDLINE records (SRC:MED) with “psilocybin” in the title or abstract, per publication year, with and without “Canada” in an author affiliation (AFF:Canada). Example query (2025).
  • Law. From our law tracker, where each entry restates official texts and carries its own check date (4 October 2026 to 17 October 2026). We re-read Health Canada’s psilocybin page and LEGISinfo’s record of Bill C-286 on 26 October 2026.
  • Access figures. Health Canada’s question-period note of 14 December 2022 (opened 26 October 2026), and Health Canada data obtained under Access to Information as reported in a 2025 peer-reviewed comment (Garel et al.). Health Canada has not published those yearly figures itself, as far as we could find.

Limits

  • Registry records are entered and updated by each study team; statuses and dates can be out of date. Start and completion dates may be anticipated rather than actual.
  • A location search finds studies that list a Canadian site; it misses Canadian-led studies that run only abroad, and studies not registered on ClinicalTrials.gov. Health Canada’s own clinical trials database is a separate source and does not line up exactly.
  • Enrolment totals are each study’s planned or actual number across all its sites, not participants in Canada.
  • Records can contain entry errors. One multi-site record (NCT05711940) lists its Québec site with the province “B.C.”; we count provinces as the records give them, and that study has British Columbia sites as well.
  • Affiliation matching in Europe PMC depends on the affiliation data each record carries, so counts are a floor; the most recent months are still being indexed.
  • Special Access Program figures count requests, and end in December 2024.
