GLOSSARY · LAW AND ACCESS

Schedule III (Canada)

The schedule of Canada’s Controlled Drugs and Substances Act that lists psilocin and psilocybin, along with LSD, DMT and mescaline. Possessing, trafficking or producing a Schedule III substance is an offence unless authorized.

Schedule III of the Controlled Drugs and Substances Act lists LSD as item 5, DMT as item 7, psilocin as item 11 and psilocybin as item 12, each “and any salt thereof” (Justice Laws, CDSA). Mescaline is item 17, worded to exclude peyote.

The schedule matters because the Act’s offences and maximum penalties are set by schedule. Section 4 says that, except as authorized under the regulations, no person shall possess a substance in Schedules I, II or III. For Schedule III, possession is punishable by up to three years on indictment, while trafficking and production carry up to ten years on indictment or 18 months on summary conviction (Justice Laws, CDSA). These are maximums, not typical sentences.

Health Canada sums up the effect: under the Act, sale, possession and production of magic mushrooms, psilocybin and psilocin are illegal unless Health Canada authorizes them (Health Canada, magic mushrooms). The schedule names the compounds; its numbering is unrelated to the US Schedule I or the UN treaty’s schedules. Not legal advice.
