Schedule I is one of five schedules created by the US Controlled Substances Act. The statute sets three findings for it: a high potential for abuse, no currently accepted medical use in treatment in the United States, and a lack of accepted safety for use under medical supervision (21 U.S.C. § 812). Psilocybin and psilocyn appear in the statute’s original Schedule I list.
The current federal regulation, 21 CFR 1308.11, still lists psilocybin and psilocyn among Schedule I hallucinogenic substances (eCFR, 21 CFR 1308.11). The version we opened was dated 21 September 2026.
State programs in Oregon and Colorado license psilocybin services under state law, but they do not change the federal listing (Oregon Health Authority). Canada uses a different structure: psilocin and psilocybin sit in Schedule III of the Controlled Drugs and Substances Act, and the numbering of the two countries’ schedules does not line up.
