GLOSSARY · LAW AND ACCESS

Licensed dealer

Also called: dealer’s licence

A company or organization licensed by Health Canada to produce, import, export or distribute controlled substances. Since 1 October 2026 the licence is issued under the Controlled Substances Regulations.

In the Controlled Substances Regulations, a licensed dealer means the holder of a licence issued under subsection 12(1) (Justice Laws, CSR). The regulations require a dealer’s licence for each site where certain activities, such as producing a controlled substance, take place, and set out how licences are issued, renewed, amended, suspended and revoked (Justice Laws, CSR).

Licensed dealers are part of every lawful psilocybin route. Health Canada says that when a Special Access Program request is authorized, the product must be imported by a licensed dealer who has psilocybin listed on their licence, and that organizations wanting to conduct activities with psilocybin or magic mushrooms need a licence, authorization or exemption (Health Canada, magic mushrooms).

The new regulations replaced earlier rules spread across several instruments, including the Narcotic Control Regulations and Parts G and J of the Food and Drug Regulations (Canada Gazette, SOR/2025-242). A dealer’s licence does not let the public buy psilocybin. Not legal advice.
